Department of Building Safety Announces New Homeowner Contractor Affidavit Requirement

The Fayette County Department of Building Safety announces a new requirement for homeowners acting as their own contractor, effective January 1, 2026.

Beginning in January, any homeowner who chooses to serve as their own contractor must submit a Homeowner Contractor Affidavit at the time of permit application. Permit applications will not be accepted for review unless the affidavit is included. The FC Homeowner Contractor Affidavit is available on the Fayette County website.

Affidavit Requirements
The affidavit must confirm that the homeowner:
  • Is acting as their own contractor for work on their own property.
  • Is not building with the intent to sell, lease, or rent the structure within 24 months of completion, as required by Georgia law.
  • Will personally supervise all work and comply with all applicable local and state requirements.
  • Will hire properly licensed subcontractors for all regulated trades.
  • Accepts full responsibility for code compliance, jobsite conditions, and liability.
This requirement ensures compliance with Georgia law and supports safe, responsible construction practices within the county.
